Abstract
Last Will of Henry William Johnstone Bonnycastle Dale of Middle Clyde River, Nova Scotia, Canada.
This is the Last Will and Testament of me Henry William Johnstone Bonnycastle Dale of Middle Clyde River, Nova Scotia, Canada, made this Thirtieth day of May, Nineteen hundred and Thirty-six. I revoke all former Wills and Testamentary Dispositions by me at any time heretofore made and declare this only to be and contain my last Will and Testament.
I direct all my just debts, funeral and Testamentary expenses to be paid and satisfied by my Executors hereinafter named as soon as conveniently may be after my decease.
I give, devise and bequeath all my real and personal estate of which I may die possessed, in the following manner, that is to say: To be divided equally amongst those hereinafter designated as my selected heirs or such of them as may be living at my decease, that is to say:
My half sister Mary Louise Waddingham now of Peterborough, Ontario, and my friend Cecil Griffith, son of William Griffith of Kettleby, Ontario. And it is my desire that in carrying out this bequest, my Executors as far as possible should divide my stocks, Bonds, Shares or Securities or Money in the aforesaid manner, and annuities.
The above general bequest shall not, however, be deemed to include such personal property as is now in my home other than stocks, bonds, shares, or securities for money as such personal property has been given by me to said Cecil Griffith at various times in lieu of wages and money compensation for his services. This personal property which I here designate as belonging to Cecil Griffith includes a Ford Car, household goods, clothes, typewriter, cameras, negatives, especially including a collection of about four thousand negatives, books, hunting outfit, canoe, and all ownership and copyright in all my books, writings and negatives, and I instruct the said Cecil Griffith to use my name in his writings, only signing it "Bonnycastle Dale Jr". The provisions in this clause of my will are hereby made by me as a reward to dear Cecil Griffith for his great kindness to me.
All the residue of my Estate not hereinbefore disposed of I give devise and bequeath to my two selected heirs. This aforesaid residue include, however, the reversion of the Life Interest in lots 90, 91, 92, and 93 and 94 of Old Soldier's Location Lots, Middle Clyde, nova Scotia, legally made over to me during life by the said Cecil Griffith. This life Interest lapses, expires at my death, leaving said Mary Louise Waddingham and Cecil Griffith equal owners of the said Lands and house.
And I nominate and appoint the said Cecil Griffith and Mary Louise Waddingham to be my Executors of this my last Will and Testament, hereby authorizing them to pay all my just debts and use all legal powers necessary for the settlement of my Estate without being obliged to give security of any kind in respect of their administration of my Estate.
