The two brothers were to inherit all their father's estate of land and fee simple in the town of Cheriton Fitzpaine called Pynes, as well as the residue of the estate after a couple of minor bequests. Richard was also bequeathed £70.2

Last Will and Testament of Richard Oliver of Cheriton Fitzpaine, yeoman

To sons William and Edward two dwelling houses now building in the Village of Cheriton Fitzpaine on the north side of his present house, including the timber lying in the orchard to complete the building, all in his estate called Pynes

To sons William and Edward £20 each out of the surplus of Pynes when sold

Edward shall have first choice when the two houses are completed

To son William the dairy and chamber over it situated on the left hand side of the passage leading in from the village together with part of the garden on the eastern side of the wall south from the gate leading in from the same, after the death of Richard’s wife Sarah. If William should die without issue before Sarah, then it is to be split among all his children as tenants in common.

To son Richard and daughter Sarah as tenants in common his dwelling house now in the occupation of Elizabeth Prior together with the part of the garden thereto now in the occupation of William Cruwys on the west side of the gutter, all part of Pynes.

To son Thomas his dwelling house and garden which extends to the hedge on the south side, from the [---] on the north side adjoining the village now in the occupation of William Cruwys. Apponted son in law William Pasmore of Cadeleigh and brother in law John Rattenbury of Witheridge to let Thomas’ house and to hold the proceeds in trust for him until he reached the age of twenty-one.

To son John and daughter Mary his dwelling house and premises called Ring of Bells in Cheriton Fitzpaine and now in their possession, during Richard’s present holding. Also to John and Mary any goods or chattels of his that they have at his decease.

Research Note There is an entry in the death index in 1879 for a Thomas Maunder, age 40, in Lambeth.7 
1881 CensusRhoda Maunders appeared on the 1881 Census of Lambeth, London, at St Thomas' Hospital. The hospital was situated on Palace Road, Albert Embarnkment. She was 35 years old, a widow, and born in Cheriton Fitz Prince [sic] Devons. Rhoda was one of thirty probationer nurses.8 
1901 CensusRhoda Maunder appeared on the 1901 Census of Bournemouth, Hampshire, at Mont Dore Hotel. The census was taken on March 31st. Rhoda was 50, a widow, worked as a hospital nurse, and was born in Cheriton Fitz Paine Devon.9 
1911 CensusRhoda Maunder appeared on the 1911 Census of Tiverton, Devon, at 2 Wellbrook Street. She lived alone in one room. Rhoda was 65, a widow, professional nurse, birthplace Cheriton Fitzpaine.10 
DeathRhoda died in 1936.11

Life Events

Research Note Unfortunately, William's baptism was not in the Cheriton Fitzpaine register. The next task is to see how William fits in with the other Cheriton Fitzpaine Olivers. On his marriage certificate his father was identified as William, a butcher.

Investigate the charts for possiblilities.

Possible fathers that I can see are:
1) William who married Margaret Aplin in 1798. We do not know his occupation. They had a son named William in 1800 but if he died, they may have named a subsequent son William.
2) William, son of William and Susanna, who was baptised in 1778 in Stockleigh English. Nothing further is known about this William. His brother John and his father (who was from Cheriton Fitzpaine) were yeomen.
3) William, son of John and Mary, who was baptised in 1791 in Cheriton Fitzpaine
4) William, son of Richard and Sarah, who was baptised in 1797. He is a bit young to be the father but it is certainly possible. William died in 1841 and his death certificate should state his occupation. His father Richard was a yeoman, his brother Richard an innkeeper, brother John a butcher and farmer, brother Edward a farmer, and brother Thomas a schoolmaster.

 
Research Note A tiny clue has been found that might contribute to the solution of William's parentage. In his son Thomas' 1937 obituary, one of the people attending his funeral was "Mr W G Sharland (cousin)"
So, perhaps we can discover Mr Sharland's origins. Hopefully he was a cousin on Thomas' father's side.

They were married after banns by George Cumming Rashleigh. William and Mary both signed with an X. The witnesses were Richard Ley [X] and Ann Ley.3 
1841 CensusWilliam and Mary appeared on the 1841 Census of Cheriton Fitzpaine, Devon, in the Village. William was 20 and a carpenter. Mary was 20 and Lidia was 3. All were born in the county. [Note that the 1841 census records ages rounded down to the nearest 5 years, does not record relationships, and only indicates whether or not the person was born in the county.].4 
1851 CensusWilliam and Mary appeared on the 1851 Census of Cheriton Fitzpaine, Devon, at Smith Hayne. William was 35, a carpenter and born in Cheriton Fitzpaine. Mary was 32 and born in Cadleigh. They had 3 daughters - Lydia (13), Dinah (3) and Mary (1 week). Lydia was born in Cadleigh and the other two in Cheriton Fitzpaine.2 
1861 CensusWilliam and Mary appeared on the 1861 Census of Cheriton Fitzpaine, Devon, at 1 Dovers Hill. William was 42, a carpenter and born in Cheriton Fitzpaine. Mary was 41 and born in Cadleigh. Their children were Dinah (13), William H (7), John (5), Thomas (3). William and John attended school. Also with them was a grandson, Robert, age 5 born in Cheriton Fitzpaine.1 
DeathWilliam died in 1869.5

They had been married 29 years. Their children at home were Edward Percival (21, plumber), Alice Mabel (17), Leonard Thomas (16, porter). Also there were their daughter-in-law Ada Ethel Elizabeth and her son John Walter Thomas (1.)12

John was a farmer and he and Annie were Church of England. They traveled by Canadian Northern Railway.13

Ann was 33 and also born in Cheriton Fitzpaine. Their children were Edith M M (4), Reginald Owen (2), and William A A (9 months). They also had a boarder (widow age 77) and a lodger (16, porter in wine cellars.)5 
1901 CensusThomas and Ann appeared on the 1901 Census of Exeter, Devon, at the Red Lion Inn, Sidwell Street. Thomas was 42, a licensed victualler & brewer and was born in Cadeleigh. Ann was 43 and born in Cheriton Fitzpaine. Their children were Edith M M (14), Reginald O (12), and William A (10). They also had one servant.6 
Research Note I have not yet found a baptism record for the child Victor Buller Oliver. His 1902 burial record shows an address of Sidwell Street, which is where Thomas & Ann were in the 1901 census. So I think he is the sixth child (as noted in the 1911 census) for this couple.

1911 CensusThomas and Ann Oliver appeared on the 1911 Census of Exeter, Devon, at the Red Lion Hotel, 117 Sidwell Street. Thomas was an Inn Keeper and employer and Ann assisted in the business. There were 11 rooms in the dwelling. Thomas was 52 and born in Cadleigh Devon. Ann was 53, born in Cheriton Fitzpayne Devon, and was the mother of 6 children, 3 of whom were still living. Their children at home were Reginald Owen (22, brewer working at home) and William Archibald Ash (20, billiard saloon manager). Also with them was their visiting nephew Tom Oliver (14) and one domestic servant. [Note: Tom was the son of Thomas' brother William Henry]8

Funeral of Mr Tom Oliver
CHERITON FITZPAINE NATIVE

The regret caused by the death of Mr Tom Oliver, of 6, Church-terrace, Exeter, was evidenced by the representative attendance at the funeral on Monday at the Higher Cemetery.
Mr Oliver, a native of Cheriton Fitzpaine, was with the St Anne's Well Brewery Company for a number of years and later was licensee of the Red Lion, Sidwell-street. Keenly interested in sport, he was one of the founders of Exeter City F.C. Mr Oliver, who died on Wednesday at the age of 78, was associated with the 1st R.V's, and for a period was a member of Exeter City Council.
The immediate mourners were Mr and Mrs R O Oliver (son and daughter-in-law), Mr and Mrs W A Oliver (son and daughter-in-law), Mr and Mrs W J Hosegood Clarke (son-in-law and daughter), Messrs Geoffrey Clarke, William Clarke, Jack Oliver and Jim Oliver (grandsons), Miss Joyce Oliver, Miss Ivy Oliver, Miss Myrtle Oliver and Miss Bunty Oliver (grand-daughters), Miss Toomer (housekeeper), Mrs B M Belard, Torquay, and Mrs S Odam, Exeter (nieces), and Mr and Mrs S Howard, North Tawton (nephew and niece).
The service was conducted by the Rev H T Millman (assistant curate, Heavitree).
Among those present were [a long list, including:] Mr W G Sharland (cousin), Mrs Greenslade (Cheriton Fitzpaine).
The coffin was of unpolished English oak with brass mountings, and the breastplate bore the inscription: "Thomas Oliver, died February 10th, 1937, aged 78."9

Details from the register: George Foot & Sarah Shean, both of this parish, married in this church by banns. George signed with an X but Sarah signed her name. The witnesses were Maria Andrews [X] and Charles Foot [not certain who this is].2

Research Note Not yet found in the 1841 census. The "Montague" found with Francis' mother in the 1841 is probably his cousin. 
DeathFrancis died on 4 Aug 1846.3

MarriageHe married Ann Jewry on 10 Jan 1803 in Maperton, Somerset.
The marriage was recorded on a loose piece of paper, as were several others. It reads:
"James Foot Sojourner of this Parish and Ann Jewry of this Parish were married in this Church by Banns this tenth of January in the year of our Lord one Thousand eight Hundred & three by Mr Gatehouse Curate"
James signed his name and Ann made her mark. The witnesses were William Foot and Susanna Foot, who each signed their name. [William and Susanna were his brother and sister-in-law]2 
1841 CensusJames and Ann Foot appeared on the 1841 Census of Compton Pauncefoot, Somerset. They were both 60 years old and James was an agricultural labourer. With them were [their children] Thomas (15) and Jane (14), as well as [their son] Edward (25), [his wife] Louisa (20), [their deceased daughter Ann's daughter] Ellen (4) and [Louisa's son] William (1). Everyone was born in Somerset.
Note that in the 1841 census ages were rounded down and relationships were not recorded.3 
DeathJames died in 1848 in Compton Pauncefoot.

Research Note A few weeks after they were married, their daughter Ellen was born. 
DeathAnn died shortly after Ellen's birth. 
BurialShe was buried on 18 Jul 1837 in Compton Pauncefoot. The burial register noted that Ann was 28 years old.3 
Research Note I have heard from other researchers that Ann's widowed husband remarried and immigrated to Australia. Their daughter Ellen was raised by Ann's parents, James & Ann Foot. Ellen went to Australia as a young married woman.

Wincanton Petty Sessions.
Samuel Foot and Alfred Foot, father and son, were summoned for assaulting George Foot at Compton Pauncefoot, on Wednesday, Oct 23rd. Samuel Foot pleaded guilty. From the evidence of complainant and a witness named George Adams, it appeared that on the day in question, the parties had been treated with a public dinner, as was their usual custom when they paid their rent. They had all been drinking rather freely, and on complainant leaving the room, Alfred Foot accused him of stepping on his toes. They had some angry words, and finally both defendants struck the complainant's giving him a black eye. They were each fined 7s 6d.6

Charlotte and their youngest child Maria (3) were with Charlotte's parents in the 1861 census.6 
1871 CensusThomas appeared on the 1871 Census of Winchester, Hampshire, at 33 Upper Brook Street. He was a widower, age 46, occupation Carman, born in Compton Pauncefoot. His children were George (18, labourer), Maria (13, scholar), and Thomas (7). Thomas was born in Farley Hants.
Also in the household were Thomas' sister and brother-in-law Ann and T Shawyer [I believe this was an error; Ann was actually Thomas' daughter].7 
MarriageThomas Foot married Mary Ann Rogers in 1871 in Winchester, Hampshire.8
 
1881 CensusThomas and Mary A Foot appeared on the 1881 Census of Winchester, Hampshire, at 34 Upper Brook Street. No one else was in the household. Thomas was 46, a Laborer, born in Compton Somersetshire. Mary A was 48 and born in West End, Hampshire.9 
1891 CensusThomas and Mary Ann appeared on the 1891 Census of West Wellow, Wiltshire, at Rockingham Arms, Canada Road. Thomas was 66, a Publican, and was born in Compton Pauncefoot, Somerset. Mary Ann was 60 and born in West End, Hants.10 
1901 CensusThomas and Mary Foote appeared on the 1901 Census of Salisbury, Wiltshire, at Pheasant Inn, Rollestone Street. Thomas was 77, a Licensed Victualler working on his own account, and was born in Compton Pauncefoot, Somerset. Mary was 69 and born in Southampton, Hants.11 
1911 CensusThomas and Mary Ann appeared on the 1911 Census of Salisbury, Wiltshire, at 2 Alma Place, Endless Street. Mary Ann completed the census form. Thomas was 87, was formerly an agricultural carter, and was born in Compton Pauncefoot. Mary Ann was 78 and born in West End Southampton. They had been married 39 years and had no children together.12 
DeathThomas died circa 1914.13

They were married in the parish church after banns. Charles signed his name and Jane signed with an X. The witnesses were Thomas Foot [X] [probably Jane's brother] and Eliza Perry [X].3 
1851 CensusCharles and Jane Harvey appeared on the 1851 Census of Wincanton, Somerset, at Mill Street. Charles was 27, a Tailor, and born in Bruton Somerset. Jane was 24 and born in Compton Pauncefoot. With them was a lodger, Isaac Vining (unmarried, 40, dealer in furniture, birthplace Wincanton).4 
1861 CensusCharles and Jane appeared on the 1861 Census of Wincanton, Somerset, at Mill Street. Charles was 39, a Tailor master, born in Bruton. Jane was 34, born in Compton Pauncefoot. Their children were Eliza (9), Allice L (5), and Alfred (4). All were scholars and born in Wincanton. There were two families in this house. The family were all boarders and the head of household was Isaac Vining.6 
1881 CensusCharles and Jane appeared on the 1881 Census of Wincanton, Somerset, at Mill Street. The family was still boarding with Isaac Vining. Charles was 56, a Tailor, born in Bruton. Jane was 56, born in Compton Pauncefoot. Their children were Julia (19), Rebecca (17), Henrietta (10), and Eliza J (2 months.)7 
Research Note Henrietta was recorded as their child but was most likely a grandchild, as the entry for her in the GRO birth index indicated that her parents were not married. 
1891 CensusJane Harvey appeared on the 1891 Census of Wincanton, Somerset, at Mill Street. She was the head of the household, widowed, age 61, born in Compton Pauncefoot. With her were her son Crispen (26, furniture dealer), granddaughter Eliza Harvey (10), and a boarder (Rose Couckes, 7.)8

1901 CensusEllen Lambert appeared on the 1901 Census of Hutton, Somerset, at Hutton Hill. She was 51, a widow, born in Compton Pauncefoot, and was the housekeeper to Francis Gardener, gamekeeper. Also in the household was an under keeper. Her children Florence (16) and Archibald (13) were general servants living with her son Edward H (25) and his young family in Banwell.9 
Newspaper At the Weston-super-Mare Petty Sessions in 1907 was a case where Francis Howard Aucott and Nellie Aucott were summoned on the information of Thos Jones, inspector of nuisances to the Urban District Council because they had meat in their shop that was unfit for human consumption.
The defendants made the excuse that the meat was "meant for Mrs Gardner, a woman who called for meat for her pigs and dogs."
The female defendant said it was a pity the inspector did not wait a little longer before calling, as all the meat would have been given to a woman in the country for the dogs and pigs.
The male defendant said since he was warned last summer, his shop had been cleared two or three times a week of the refuse, and Mrs Gardner, of Shiplett, came to take it away.
The newspaper went on, "Ellen Lambert, the woman spoken of as Mrs Gardner, said she was a housekeeper at Bleadon. She went two or three times a week to defendants to take the refuse meat away for the dogs. She had been in the habit of doing so ever since Mr Aucott opened the shop. She went to the shop on the day in question and saw Mr Jones there. She left a basket of vegetables and called again, but then the meat was taken away and she could not have it."
The male defendant was sentenced to two months' imprisonment. The female defendant was dismissed on the ground that she was acting under the influence of her husband.10 
1911 CensusEllen Lambert appeared on the 1911 Census of Monkton Heathfield, Somerset. She was the housekeeper to Francis Gardner (65, single, rabbit trapper). Ellen was 60, a widow, and born in Compton Pauncefoot. Their residence had 3 rooms.11
